UWM Faces Lawsuits For Sexual Harassment And Discrimination

United Wholesale Mortgage (UWM) is being sued by two former employees, Jackson and Kassandra Memmer, who have filed separate lawsuits accusing the company of sexual harassment, retaliation, and violations related to COVID-19 return-to-work policies.

Jackson Memmer, a transgender man, alleges that he was fired following his paternity leave because of an internal appraisal clearing conditions investigation. Kassandra Memmer resigned because UWM denied her requests to work remotely during her pregnancy. Both lawsuits also include allegations of sexual harassment.

The lawsuits were filed in the U.S. District Court for the Eastern District of Michigan, focusing on UWM’s handling of health and safety protocols during the pandemic and failure to pay overtime. Previously, UWM settled a $2.75 million case regarding unpaid overtime for account executives.

These lawsuits follow a workplace complaint from another former employee that drew attention from the National Labor Relations Board (NLRB).

After lodging their grievances with the Equal Employment Opportunity Commission (EEOC), the Memmers obtained authorization in January to pursue individual lawsuits.

UWM has declined to comment on the ongoing legal matters.

Both the Memmers joined the company as conventional mortgage loan underwriters towards the end of 2019. Kassandra was later promoted to senior underwriter. During the loan process, Kassandra discovered Jackson’s transgender identity, which became known to several UWM supervisors.

Both lawsuits highlight instances of sexual harassment. Kassandra was harassed by a male broker who sent inappropriate emails expressing romantic interest. When she reported the harassment, her concerns were dismissed. Jackson alleges he was sexually harassed by a male broker, creating a hostile work environment.

Former UWM employee Kassandra was denied remote work during her pregnancy and resigned when UWM mandated employees to return to the office. Her final bonus was not provided. Jackson, another former employee, was terminated and denied a $5,000 bonus after an investigation during his paternity leave.

Both lawsuits accuse UWM of failing to pay minimum and overtime wages. Kassandra seeks $250,000, while Jackson requests $100,000 in damages. The cases include allegations of a hostile work environment and violations of the Americans with Disabilities Act. The NLRB has charged UWM with violating employee rights, and a hearing is scheduled for July 25.
